Terms of Service

The rules of the service: ordering, payment, cancellation and liability.

These terms govern use of the Fin Delivery app and website. By using the service you accept them. Read sections 2, 6 and 8 at minimum — they explain who is responsible for what.

The key point, briefly

Fin Delivery is an intermediary. When you order food, you buy the food from the restaurant and the delivery service from us. The restaurant is responsible for the food; we are responsible for the delivery. We collect payment on the restaurant's behalf and handle complaints from a single point, so you do not have to chase two parties.

The service language is Finnish. The operating area is Finland.

2. Our role: intermediary, not restaurant

In these terms, seller means a restaurant or any other provider of goods or services using our platform. The platform may offer food, other goods and services, and the range may expand. These terms apply to everything ordered through the platform unless something different is stated for a particular service.

Fin Delivery operates a platform on which restaurants offer their products and customers order them. Three consequences follow:

We do not prepare or store food. We do not determine restaurants' menus or recipes.

3. Your account

3.1 Age limit

The service is intended for people aged 18 and over. Creating an account requires that you are of full age. If we find that an account was created by someone younger, we will close it.

3.2 Details and credentials

Give accurate details when creating your account and keep them current. Your delivery address, door code and phone number directly affect whether your order arrives.

Keep your password and device authentication to yourself. Do not pass them on.

3.3 Liability for orders placed on your account

You are responsible for orders placed on your account where you made that possible through your own negligence — for example by giving out your password, leaving your unlocked device in someone else's hands, or failing to notify us when you know or ought to know that someone else is using your account.

You are not responsible for orders placed without any contribution from you — for example following account takeover or use of a stolen payment instrument.

Tell us immediately

If you suspect someone else is using your account or payment method, notify us without delay at info@fin-delivery.com. We lock the account immediately. You are not liable for orders placed after your notification. Also notify your card issuer if a card is involved.

This section does not limit rights you have under the Finnish Payment Services Act or the Consumer Protection Act regarding unauthorised transactions.

4. Ordering and formation of the contract

Products and prices shown in the app are an invitation to make an offer. Your order is the offer, and the contract is formed when the restaurant accepts it and you receive confirmation in the app.

A restaurant may decline an order — for example because an item has run out, because of a rush, or because of opening hours. In that case no contract is formed, nothing is charged to you, and any charge already made is refunded.

Check the contents of your order before confirming. Information concerning special diets or allergies should be verified directly with the restaurant — we cannot guarantee that cross-contamination is avoided in a restaurant's kitchen.

5. Prices and payment

All prices include VAT. Before payment you see the product price, any delivery fee and any service fee separately, together with the total.

Payments are processed by Stripe. We neither see nor store your card details. The charge is made when the order is placed.

Promotional prices, discounts and free-delivery offers apply for the stated period and on the stated conditions. We do not apply a discount retroactively to an order already placed.

The delivery fee may vary with distance, demand, time of day and any campaigns in force. We always show you the applicable price and delivery fee before you confirm the order. We may offer you targeted benefits and discounts; if a price has been personalised specifically for you on the basis of automated decision-making, we say so at the point of ordering.

6. Cancellation

6.1 Why there is no 14-day withdrawal right

Consumers generally have a 14-day right of withdrawal in distance selling. It does not apply to prepared food. Article 16 of the Consumer Rights Directive (2011/83/EU) excludes the right of withdrawal for, among other things, goods liable to deteriorate or expire rapidly, and for catering services supplied on a specific date or within a specific period.

This is not a term we impose; it is the law, and it applies to every food delivery service.

6.2 When you can cancel

You can cancel free of charge up until the restaurant has begun preparing your order. Cancel in the app or by contacting us. Once preparation has started the order can no longer be cancelled, because the food has already been made for you.

If you cancel before preparation begins, we refund the full amount.

6.3 If we or the restaurant cancel

If an order cannot be delivered — the restaurant closes, an item runs out, no courier is available — we tell you and refund the payment in full.

7. Delivery

The delivery time shown in the app is an estimate, not a binding promise. Traffic, weather and restaurant load affect it.

Make sure you are reachable at the address you gave at the time of delivery and that your phone is available. The courier will contact you if needed.

If you cannot be reached, the courier waits a reasonable time and tries to contact you. If no contact is made, the order is deemed delivered and is not refunded — food does not keep while waiting. If you have instructed us to leave the order at the door, the order is deemed delivered once it has been left in accordance with your instruction.

The customer is responsible for a failed delivery caused by an incorrect or incomplete address.

8. Faults and complaints

Contact us, not the restaurant. Although the restaurant is responsible for the food, we handle complaints from a single point and pass the matter on.

Report a fault as soon as possible, preferably the same day, to info@fin-delivery.com or through the app. Give the order number and what was wrong. A photograph speeds up handling.

We handle the complaint and refund a justified fault in whole or in part. Refunds are made to the payment method used for the order.

You have the rights given to you by the Finnish Consumer Protection Act regardless of anything in these terms.

10. Content, moderation and notices

You may leave reviews and feedback in the service. We do not publish content that is unlawful, abusive, misleading or that infringes another person's privacy. We may remove such content and will inform the person who submitted it.

If you find unlawful content in the service, report it to info@fin-delivery.com. We handle reports without undue delay and tell the reporter what action we took.

If you disagree with a decision concerning your content, you can challenge it at the same address. We will review the matter again, by a human.

11. Availability of the service

We aim to keep the service available but do not guarantee uninterrupted operation. The service may be unavailable due to maintenance, updates or faults.

We may change the features of the service, the operating area and the selection of restaurants.

12. Limitation of liability

We are responsible for the delivery service and for what the law requires of us. The restaurant is responsible for the food as set out in section 2.

We are not liable for indirect loss, such as lost profit or lost time, to the extent the law permits liability to be limited.

What we do not limit

Nothing in these terms limits our liability for death or personal injury, for intent or gross negligence, or any liability that cannot be limited under the Finnish Consumer Protection Act.

13. Closing your account

You can delete your account at any time in the app (Settings → Account → Delete account) or on the website. What happens on deletion is described in the privacy notice.

We may close or restrict an account if it is used contrary to these terms or where there is justified reason to suspect misuse. We will tell you the reason unless the law prevents it. You can challenge the decision by contacting us; we will review the matter again.

Closing an account does not remove unpaid obligations or our statutory retention duties.

14. Changes to these terms

We may change these terms. We will notify you in the app of material changes before they take effect. Orders already placed are governed by the terms in force at the time of the order.

If you do not accept a change, you can stop using the service and delete your account.

15. Governing law and dispute resolution

These terms are governed by Finnish law. This does not deprive you of the protection afforded by the mandatory consumer law of your country of residence.

In a disagreement, contact us first — most matters are resolved there.

If the matter is not resolved, you can refer it to Consumer Advisory Services or the Consumer Disputes Board. You may also use the European Commission's online dispute resolution platform.

Disputes are heard in the Finnish courts. As a consumer you may always bring an action in the district court of your place of residence.

16. The order of content and recommendations

We are open about the basis on which restaurants and products are ordered in the app. The main factors are:

Paid visibility is always clearly marked, for example as "Ad" or "Sponsored". It does not change the price you pay and does not surface a seller who does not deliver to your address.

Your own order history affects what you see and in what order. We show products you have ordered before and also use your history to order other content. You can object to this at any time — see the privacy notice.

17. Communications

We send you service messages relating to your order by email and push notification. These form part of the contract. You can turn push notifications off in your phone's operating system settings if you wish.

We send marketing by email only, about our own products and services, either with your consent or on the basis of an existing customer relationship as permitted by the Finnish Act on Electronic Communications Services. Every marketing email carries a free unsubscribe link, and you can also write to info@fin-delivery.com.

Both the order of content in the app and the content of our marketing messages may be personalised for you. The basis is described in section 16 and in more detail in the privacy policy.

We do not sell or rent your personal data and we do not send you other companies' marketing.

18. The platform, campaigns and content

18.1 Reviews and other content you submit

When you submit a review, a photo or other content to the service, you grant us a free, worldwide, transferable right to use, display, copy and edit it in connection with the service and in marketing the service. The content remains yours, and you can request its removal. We do not attach your name to marketing without your permission.

18.2 Aggregated and non-identifying data

We may freely use aggregated, non-identifying data arising from use of the service, including to develop our services and their recommendations. No individual user can be identified from such data.

18.3 Advertising on the platform

The platform may show paid visibility and advertising. All paid content is marked. We do not disclose your personal data to advertisers.

18.4 Campaigns, benefits and referral programmes

We may offer campaigns, discount codes, benefits and referral programmes. These may carry their own terms, which we will state alongside the campaign. We may limit the use of benefits to prevent misuse.

18.5 Service area and range

The service area, range and services offered may change. We always show what is available at your address.

18.6 Business customers

We may offer separate business and invoicing accounts. These may be subject to an additional, separate agreement.
